Trial and procedure

As you may have guessed, this video is an attempt to correct a sad 2000-year-old miscarriage of justice, during a proceeding where I am put on trial, or rather, my theory is, the theory that claims to reconstruct Paleolithic language and culture using ancient texts; a theory that overturns our understanding of the great writings of the Old and New Testaments, and the Koran, but that, above all, revolutionizes our knowledge of paleoanthropology and linguistics.

And since we're talking about a trial, I'd like to take you back to the sources of law, with the help of the landmark work that is La Parole Impérieuse. In it, the great anthropologist of Law, Robert Jacob writes (p.334): « The metaphor of a dispute being CuT is very common throughout the world » - like Solomon's judgment, in what is more generally known as TRial by oRDeaL>.

A trial by ordeal was a type of trial in which the accused underwent an ordeal that was often fatal. If they survived, they were innocent. Ordeal is related to uRTeiLen in German, meaning to aRBiTRate (to tell aPaRT, DéPaRTaGer in French). TeiL in German is a PaRT. In the same vein, there's also DeCiSion, from DeCiSio in Latin, which means a TRaNSaCtion in general and comes from DeCiDeRe which has the double meaning of cutting and DeCiDing. In short, as you can see, we're back to the theme of « TRanChing », which I spoke about at length in my previous video.

In that video, I talked precisely about things that can be cut, in particular the carcass of a hunted animal. But matter is not the only thing that can be cut: time also can be cut. It's what we call a PRoCeSS, that can be broken down into several intermediate STePs following one another, at distinct points in time.

In business, we're very familiar with this: setting up a process, a PRoCeDuRe, is what guarantees that a given, reasonably STaNDaRD ReSuLT will be achieved with some level of QuaLiTy. In IT, too, we spend our time managing processes and procedures: an algorithm is a sequence of iNSTRuCTions, one following the other, in what is called iTeRation. This work of analyzing and cutting is essential in software architecture. And of course, in law, trials also follow a kind of formalism in STaGes, which we also call « procedure ».

Trimming, the art of turns

This act of dividing something into several stages, this iteration, is essential when it comes to organizing complex tasks or ideas. For example, when I make my videos, my first step is to collect ideas and semantic connections as I read and reflect, especially during the weekends when my brain is at rest. Then each week, usually on Mondays, I organize and DiSTRiBuTe those unordered ideas across the dozens of video SCRiPT projects I've started.

Then, when it's time to WRiTe a specific script, I reorganize all the ideas I've gathered for that script into ChaPTeRs that will become SiGNPoSTs in my video. This is what I call the RouGhing-in. Once the script is rough-CuT, the next step is polishing: writing a DRaFT of the script based on ideas organized in chapters.

Once I've written this draft, there will be several RouNDs of eDiTing and ReTouChing. I look for the RiGhT « TuRNs » of PhRaSes. I do some TRiMMing, (« DéTouRaGe » in French) so that progressively this script allows me to CReate a video that captures your attention, in spite of the complexity of my subjects. In short, I prepare each video as if I were living in the Paleolithic era.
