The www.parakl.ist website offers users online access to the video scripts of the Publisher CEO, Mr Emmanuel IFERGAN (the "Paraklet") in French and English (the "Scripts"). The Scripts provide access to the hidden structure of language (the "Discovery"), a trace of the sophistication of language in Homo Sapiens, at the intersection of linguistic, philological, ethnological and paleoanthropological domains.
To facilitate the acquisition of the knowledge needed to access the Discovery, these Scripts are enriched with :
the systematic indexing of certain words, in what is known as the "PaRaKLeT style", capitalizing certain consonants making up the root of said words, making it possible to constitute the world's first meta-linguistic / phono-semantic database;
the creation, for each Script, of a so-called "Structure" file, grouping these key words by Script section, identified by its title (each a "Section"). These Sections can themselves be subdivided into subgroups (each, a "Semantic Field"). The Structure of each Script also includes the sources cited - notably in the Scriptures and ancient texts (Bible, Koran, Gathas, etc.) - grouped by Section.
access, from each Section of the Structure of a Script, to copies of certain pages of reference works (each, a "Short Extract"), within the framework of the right of quotation provided for in article 10 1) of the Berne Convention on Copyright, highlighting a phono-semantic "zoning" (framed in red) (the "Library");
Access to certain areas of the www.parakl.ist website is subject to registration (see Privacy) and/or payment of a subscription fee (see Terms and Conditions).
Access to and use of the www.parakl.ist website and all its sub-domains are subject to the conditions set out below and to all applicable laws.
The Publisher makes every effort to ensure that its services are available 7 days a week, 24 hours a day.
The Publisher may, however, interrupt access to it, in particular for maintenance and upgrading purposes or for any other reason, particularly technical.
The Publisher is in no way responsible for the interruptions mentioned in point 1 and for the consequences that may arise for the User or any third party.
The Publisher is not liable for any damage or for any temporary or permanent incident that may be caused to the User's data or computer equipment during access to the site, during circulation within its pages or generally during transmission of the files and computer programs that make up the site to the User's receiving equipment. In particular, the Publisher is not responsible for the possible transmission of viruses via its site.
The Publisher is not responsible for the fraudulent use of its means of distribution. It declines all responsibility for any intrusion into its computer systems and for any plundering of any data that may result. However, the Publisher makes every effort to prevent illicit intrusions.
The Publisher declines all responsibility for indirect damage, operating loss, loss of profit, loss of opportunity, damages or costs.
The texts of the Scripts in their French and English versions are an original creation of Paraklet and are reserved under copyright and intellectual property law for the whole world.
The Courts Extracts making up the Library are reserved under copyright and intellectual property law for the entire world, for their respective authors and beneficiaries.
The Publisher states that it complies with the provisions of article 10-1 of the Berne Convention, which stipulates that "It shall be permissible to make quotations from a work which has already been lawfully made available to the public, provided that their making is compatible with fair practice, and their extent does not exceed that justified by the purpose, including quotations from newspaper articles and periodicals in the form of press summaries".
In particular :
the purpose of the Paraklet is to enable mankind to grasp the Discovery;
The underlying cognitive process involves reading short extracts from the Library, which should be contextualized with each Script Section;
The www.parakl.ist website does not allow its users to read entire books or works, as only Short Extracts are available in each Script Section;
the titles of the books or works from which the Short Extracts are taken, as well as the names of the authors, are systematically highlighted, including by means of links to sites enabling their online purchase - the aim of www.parakl.ist being to arouse the curiosity and interest of users in the Library's reference works.
Illustrations, maps and images reproduced on the www.parakl.ist website and its sub-domains are reserved under copyright and intellectual property laws worldwide.
The structure and layout of the www.parakl.ist website, as described in these Terms and Conditions of Use, is also protected by the copyright of the Publisher and, where applicable, its suppliers or partners.
In this respect, and in accordance with the provisions of the French Intellectual Property Code, the only use permitted is for private purposes, subject to different, or even more restrictive, provisions of the French Intellectual Property Code. Apart from this use, however, the User is prohibited from copying, modifying, distributing, transmitting, broadcasting, representing, reproducing, publishing, licensing, transferring or otherwise exploiting the information on the www.parakl.ist website. Consequently, any other use constitutes an infringement and is punishable under intellectual property law, unless prior written authorization has been obtained from the Publisher.
Web sites outside the domain and sub-domains of www.parakl.ist, in particular sites to which users may be directed by means of hypertext links within the pages of this site, are the sole responsibility of the owners of these web sites.
The Publisher cannot exercise any permanent control over these sites, nor can it assume any responsibility for their content. The inclusion of such links does not imply that the Publisher endorses the material contained on such sites. The Publisher therefore accepts no responsibility for the material or data of any kind contained or distributed on these linked sites, nor for any processing of personal data that may take place there.
The Publisher authorizes the creation of hypertext links to its www.parakl.ist site, provided that they do not damage the Publisher's image in the public mind. Links may be set up to pages on the site in html, php or xml format, provided that deep linking is not used, i.e. the pages on the www.parakl.ist site must not be nested within the pages of another site, but accessible by opening a window.
In order to provide a high-quality user experience, the www.parakl.ist website reserves the right to use cookie technology. Access to the site may therefore require your Internet browser to authorize the creation of cookies.
The Publisher reserves the right to take legal action in the event of a breach of these terms of use, in order to obtain compensation for any damages suffered.
Subject to the mandatory rules of public and private international law governing the User, French law governs the relationship between the Publisher and the User. Any dispute relating to the use of this site shall be governed exclusively by French law. The courts of Paris shall have exclusive jurisdiction in the event of a dispute.
The Publisher reserves the right to refuse any Internet user access to all or part of its site, unilaterally and without prior notice, in particular in the event of a clear violation of these terms by an Internet user.
If any provision hereof is declared invalid or unenforceable under applicable law, such invalid or unenforceable provision shall be deemed superseded by a valid and enforceable provision that is as close as possible in substance to the original provision, and all other provisions of the Agreement shall remain in full force and effect.
This Agreement constitutes the entire agreement between the User and the Publisher with respect to the User's Site and supersedes all prior or contemporaneous communications and proposals, whether electronic, written or oral, between the User and the Publisher with respect to the User's Site.
A printed version of this Agreement and of any disclaimer issued in electronic form shall be accepted in any judicial or administrative proceeding relating to this Agreement to the same extent and subject to the same conditions as other business documents and records created and maintained in printed form.
In the case of temporary access arrangements implemented in exceptional circumstances, the Publisher reserves the right to limit usage or interrupt access granted on the basis of false declarations (e.g. regarding membership of a subscribing institution).
The Publisher reserves the right to modify the terms, conditions and notices under which this site is offered.
